Eligibility Requirements for Divorce in Massachusetts

Before filing for divorce in Plymouth County, it’s worth confirming you meet Massachusetts’s threshold requirements. The Plymouth Probate and Family Court has jurisdiction over all Plymouth County municipalities, and cases filed there must satisfy the state’s residency and grounds standards.

Residency Requirements

Massachusetts residency requirements depend on where the cause of the divorce occurred. If the cause occurred outside Massachusetts, at least one spouse must have lived in the state continuously for at least one year immediately before filing. If the cause occurred in Massachusetts, the requirement is satisfied as long as one spouse is currently domiciled in the state. No minimum duration applies.

Grounds for Divorce

Massachusetts permits both no-fault and fault-based divorce. No-fault divorce is based on an irretrievable breakdown of the marriage. Under M.G.L. c. 208, § 1, fault-based grounds include adultery, desertion, cruel and abusive treatment, and others. Understanding which path applies to your situation is part of building an effective legal strategy from the start.
