Parenting Time & Visitation in Massachusetts

Massachusetts courts generally use the term parenting time for schedules governing a non-custodial parent’s time with a child. Visitation remains the term used in specific legal contexts: supervised visitation under MGL c. 209 Section 38 and grandparent visitation under MGL c. 119 Section 39D. The distinction matters because the two tracks can involve different standards and procedures.

When parents reach an agreement, their attorneys present a parenting plan to the Massachusetts Probate and Family Court. If the court finds it serves the child’s best interests, it becomes a binding order. When parents can’t agree, a judge sets the schedule, and changing it later requires a formal court process. Massachusetts courts presume that a meaningful relationship with both parents serves the child’s interests, so outright denial of parenting time is rare and requires significant justification.

Types of Parenting Time Arrangements

Massachusetts courts and parents work with several recognized schedule structures. The right arrangement depends on the child’s age, each parent’s availability, and the level of conflict between the parties.

• Standard parenting time: A regular schedule set by agreement or court order, typically including alternating weekends, mid-week contact, alternating holidays, and extended time in the summer.
• Shared parenting time: Both parents have significant and regular time with the child, in formats such as alternating weeks or split weekday and weekend schedules.
• Supervised parenting time: When the court identifies safety concerns such as a history of abuse, substance abuse, or neglect, it may require a neutral third party or professional supervisor to be present during visits, consistent with Probate and Family Court Standing Order 1-23.
• Reasonable parenting time: An informal arrangement for parents who communicate well enough to schedule visits without a fixed order. Not suitable for high-conflict situations.
